Terms of Use for MyBaby - Baby Tracker

1. Acceptance of Terms

By downloading, installing, or using MyBaby - Baby Tracker ("App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. Description of Service

The App provides features such as baby care and development tracking, daily records, feeding, sleep, tummy time, water, weight, medication, appointments, questions, letters, shopping lists, reports, optional photo/file attachments, reminders, and a community forum. Features may vary depending on version, device, platform, or Premium status.

3. Not Medical Advice

The App is for informational and personal record-keeping purposes only. It is not a medical device; it does not provide diagnosis, treatment, prescriptions, emergency healthcare, or professional medical evaluation. Always consult qualified healthcare professionals when making decisions about your baby's health.

4. Accounts and Guest Use

The App can be used without creating an account. In guest mode, some data is stored locally on your device. When you create an account, supported data may be synced with your account. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.

5. Premium and Purchases

The App may offer permanent Premium access through a one-time purchase. Premium features may include unlimited or extended record history, report archive, letters, shopping lists, and other supported advanced features. Purchases are processed through the Apple App Store; prices, taxes, payment, and refund processes are subject to Apple's terms.

6. User Content and Forum

You retain ownership of the content you create. To operate and improve the App, you grant us a limited, non-exclusive, royalty-free license to host, store, display, and process your content. You are responsible for the posts and replies you publish, and you agree not to publish unlawful, harmful, misleading, harassing, or infringing content.

7. Prohibited Conduct

You agree not to:

• Violate applicable laws or third-party rights.
• Harass, threaten, or impersonate others.
• Attempt to gain unauthorized access to the App, users, or our systems.
• Bypass security measures or reverse engineer the App except where permitted by law.
• Distribute malware, spam, or abusive content.

8. Moderation and Termination

If we reasonably believe these Terms have been violated, or if needed to protect users, babies, caregivers, or the service, we may remove content, suspend access, or terminate access. Where practical, we may change or discontinue features or the App with reasonable prior notice.

9. Intellectual Property

The App, trademarks, designs, software, and original materials are owned by us or our licensors and are protected by intellectual property laws. No rights are transferred except for the use offered through the App.

10. Third-Party Services

The App relies on infrastructure providers and services such as Supabase, RevenueCat, and the Apple App Store. To the extent you interact with these services through the App, their terms and policies may also apply.

11. Disclaimers

The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation or that all of your records will be preserved in every circumstance.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use, arising from your use of the App. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the greatest extent permitted by law.

13. Indemnity

You agree, within the limits of applicable law, to defend and hold us harmless from claims arising from your content, misuse of the App, or violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. We will publish the updated text on this page and change the "Last Updated" date. Continued use of the App after changes constitutes acceptance unless applicable law requires an additional step.

15. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules, unless mandatory consumer protection rules in your country require otherwise.
