Terms of Use for mybabe

1. Acceptance of Terms

By downloading, installing, or using mybabe ("App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. Description of Service

mybabe provides tools for pregnancy and baby-age tracking, diary logs (including optional photos), optional medication reminders, subscription-based premium features, and a community forum. Features may vary by version or platform.

3. Not Medical Advice

The App is for informational and personal record-keeping purposes only. It is not a medical device and does not provide medical diagnosis, treatment, or emergency services. Always consult a qualified healthcare professional for medical decisions.

4. Accounts and Security

You are responsible for the accuracy of information you provide and for keeping your login credentials confidential. Notify us promptly at the contact email below if you suspect unauthorized access to your account.

5. User Content and Forum

You retain ownership of content you create. You grant us a limited, non-exclusive, royalty-free license to host, store, display, and process your content solely to operate and improve the App. You are responsible for your posts and replies and must not publish unlawful, harmful, or infringing content.

6. Prohibited Conduct

You agree not to:

• Violate applicable laws or third-party rights.
• Harass, threaten, or impersonate others.
• Attempt to gain unauthorized access to the App, its users, or our systems.
• Reverse engineer or circumvent security measures except where permitted by law.
• Use the App to distribute malware or spam.

7. Moderation and Termination

We may remove content, suspend, or terminate access to the App if we reasonably believe these Terms are violated or if necessary to protect users or the service. We may also discontinue features or the App with reasonable notice where practicable.

8. Intellectual Property

The App, its branding, and original materials are owned by us or our licensors and are protected by intellectual property laws. No rights are granted except the limited license to use the App as offered.

9. Third-Party Services

The App may rely on third-party services for infrastructure, authentication, database storage, file storage, and subscription management. These services may include Supabase and Adapty. Their terms and policies may also apply to the extent you interact with those services through the App.

10. Disclaimers

The App is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the greatest extent permitted.

12. Indemnity

You agree to defend and indemnify us against claims arising from your content or your violation of these Terms, subject to applicable law.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date. Continued use of the App after changes constitutes acceptance unless applicable law requires additional steps.

14. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles, unless mandatory consumer protections in your country provide otherwise.

16. Subscriptions and Payments

mybabe may offer optional Premium subscriptions. Subscription purchases are processed through the Apple App Store, and payment is charged to your Apple ID account.

Premium subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your Apple ID account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel your subscription from your App Store account settings. If you cancel, your Premium access will continue until the end of the current billing period.

If a free trial, promotional offer, or discount is available, the applicable conditions will be shown on the purchase screen. mybabe may not currently offer a free trial.

Purchases, renewals, cancellations, and refunds are subject to Apple’s App Store payment and subscription rules.

17. Privacy

Your use of the App is also governed by our Privacy Policy.
